Application under Section 6 of Right to Information Act 2005
Respected Sir,
Kindly provide me the following information, requested under the purview of the Right to Information Act 2005.
Subject: Regarding criteria for shortlisting for seats in evacuation flights to India in coordination with your mission arising out of covid19 pandemic and subsequent issues.
1. Certified copy of the criteria followed in shortlisting passengers for evacuation flights.
2. Certified copy of all communications and notes regarding formulation of the criteria followed in shortlisting passengers for evacuation flights.
3. List of evacuation flights till date with the following details full passenger capacity(number of seats without considering social distancing), number of shortlisted passengers, number of pregnant passengers, number of passengers registered in madad.gov.in, number of passengers granted assistance from ICWF, number of passengers for whom ticket was paid from ICWF, number of passengers on expired visit visa, number of passengers on expired business visa, number of passengers on final exit visa, number of passengers who were staying in shelters for stranded Indians, number of passengers who were released from jails, number of passengers who had case with employer, number of family and children separated due to lockdown, Any other categories
4. List of passengers of each evacuation flight and the category in which they managed to secure their seat and the type of supporting document provided to establish their claim
5. How much funds were being spent by this mission for evacuation? Please provide details of source of funds and heads of expenses
6. How many Indian citizens who applied for assistance from ICWF remain waiting for evacuation, in area under your mission.

Sir,
For my request for Information regarding Regarding criteria for shortlisting for seats in evacuation flights to India, the reply by, CPIO, is not acceptable. I have the following grievances and prays.
1. The reply is indication of the rampant corruption in the embassy, especially, in shortlisting beneficiaries of the evacuation flights. The RTI act is enacted to curtail such corruption, but section 4 is still not implemented and this reply is a classic example of how government officials sabotage the constitution.
2. PIO is deliberately trying to sweep the evidence of corruption under the mat, by not providing any relevant information. Detailed as below
1. Satisfactory information is provided
2. Information is denies citing “internal communication”, without citing any exemption granted by the RTI ACT. This information should be provided.
3. List of flights is given, but the most relavant information that would reveal, whether the shortlisting criteria was followed or sabotaged by the corrupt, is not provided. This is a deliberate attempt of the PIO to perpetuate corruption.
4. List of passengers is not personal and the priority criteria is not personal information. This information is usually pasted outside trains and notice boards. Documents provided could be personal, but at least the type and description of document could be provided. Whether the information is also available with some other public authority is not at all relevant to deny the information
1. Kindly give direction to PIO, to apply section 10 of RTI act to remove personal and Confidential information like intimate personal details, passwords, encryption etc. from the information and provide the sanitized information
5. The PIO has evaded the disclosure of information, by pointing out to a circular, which only says ticket and quarantine to be borne by passengers. But has not provided any answer on whether the mission draw any funds from indian community welfare fund , in the name of any fictitious or real expense.
6. Satisfactory information is provided


Hence, I request you to direct the PIO to provide full information, as pointed out above.
I request you to provide me copy of counter statement/defense filed by cpio against this appeal and file notes etc. regarding this appeal.

6. Another sure indicator or corruption, whether the most deserving candidates were given priority or not provided
None of the information requested above, excluding medical reports, is personal information. In fact, the information asked is the list of beneficiaries and how they were selected, Such information is supposed to be published on website as per section 4 or RTI Act.

In the case of S.P. Gupta v. President of India and Ors., AIR 1982 SC 149, a seven Judge Bench of supreme Court made the following observations regarding the right to information:-
“There is also in every democracy a certain amount of public suspicion and distrust of Government, varying of course from time to time according to its performance, which prompts people to insist upon maximum exposure of its functioning. It is axiomatic that every action of the Government must be actuated by public interest but even so we find cases, though not many, where Governmental action is taken not for public good but for personal gain or other extraneous considerations. Sometimes Governmental action is influenced by political and other motivations and pressures and at times, there are also instances of misuse or abuse of authority on the part of the executive. Now, if secrecy were to be observed in the functioning of Government and the processes of Government were to be kept hidden from public scrutiny, it would tend to promote and encourage oppression, corruption and misuse or abuse of authority, for it would all be shrouded in the veil of secrecy without any public accountability. But if there is an open Government with means of information available to the public, there would be greater exposure of the functioning of Government and it would help to assure the people a better and more efficient administration. There can be little doubt that exposure to public gaze and scrutiny is one of the surest means of achieving a clean and healthy administration. It has been truly said that an open Government is clean Government and a powerful safeguard against political and administrative aberration and inefficiency.”
Hence, I request you to direct the PIO to provide full information, as pointed out above.
I request you to provide me copy of counter statement/defense filed by cpio against this appeal and file notes etc. regarding this appeal.

Dear Mr. Dominic,


Reference your RTI query no. MEAAD/R/E/20/00025 received on 08.05.2020. The response of the Embassy of India, Abu Dhabi is as under :


i. As per directives of the govt. of India, priority is given to Laid off blue collar workers,

Students, Pregnant ladies, ill and aged people while shortlisting passengers for the evacuation flights.


ii. No such notes are generated


iii. The details of all evacuation flights are available on the MEA website under the head

of Covid-19 Updates. https://mea.gov.in/covid-19-updates.htm. As on 07 June, 2020, Three (03) persons have been sent to India under the ICWF.


iv. As the list contains personal particulars of the passengers, the list cannot be shared

as per section 8(j) of RTI Act 2005. The persons were shortlisted on the basis of information provided by them on the portal at the time of registration.


v & vi . The information sought is present in scattered form in the records of the Embassy and compiling the same would disproportionately divert the resources of the public authority. Hence the sought information cannot be provided in the desired format under Section 7(9) of RTI Act 2005.
